Terms of sale

These terms apply when you buy from BE Shop. The seller is Binary Elements (MRY Pty Ltd, ABN 64 113 015 259). By placing an order you agree to them.

Prices and payment

• Prices are in Australian dollars and include GST.
• You’ll receive a tax invoice by email. Card payments are processed securely by Stripe; we never see or store your card number.
• To protect you and us from fraud, card payments may need to be verified with your bank (3D Secure), and we may decline or cancel an order that our payment provider flags as high risk. If that happens, you won’t be charged.
• If a price on the site is clearly wrong (for example a typing or feed error), we may cancel the order and refund you in full, even after you’ve paid.

Orders and stock

• Stock levels come from our distributor and update several times a day, so occasionally an item sells out after you order. We’ll let you know, and you can wait, swap or get a full refund.
• We may accept or decline any order. An order is accepted once we confirm it by email.
• Product descriptions and images come from the manufacturer and distributor; minor differences in packaging or appearance can occur.

Delivery and risk

• Delivery times are estimates. The goods become yours once they’re paid for in full and delivered.
• Check your delivery and report damage or missing items within 24 hours (see our returns policy).

Warranty and returns

See our returns, refunds & warranty policy. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.

Liability

To the extent the law allows, our liability for goods that aren’t ordinarily acquired for personal, domestic or household use is limited to replacing or repairing the goods, or paying the cost of doing so. We’re not liable for indirect or consequential loss, such as lost profits or downtime.

Time price

A time price is a lower price shown on a product for a limited time (for example, an hour from your first visit). It applies only to orders placed before it runs out, as shown in your cart at checkout, and we may change or end it at any time. Subscriber codes for BE Messaging, BE Voice and BE Hub customers give a further discount; they’re for subscribers only and we may cancel orders that use one without being entitled to it.

Accounts

Orders on account are available only to customers we approve, and are payable within the terms we agree with you in writing.

Privacy

We use your details only to process and deliver your order, provide support and send order updates. We share them only with those who need them to do that (our distributor, carriers and payment processor).

Law

These terms are governed by the laws of Victoria, Australia.
